Iconic Myrtle Beach rollercoaster leaves man paralyzed, lawsuit alleges

A North Carolina woman has accused an amusement park in Myrtle Beach of negligence, claiming that her husband is now paralyzed due to one of its rides. The woman, from Guilford County, has filed a lawsuit in Horry County against Family Kingdom and Ocean Avenue Attractions, among others.
According to her claims, her husband suffered acute spinal cord damage leading to quadriplegia after riding the popular Swamp Fox Roller Coaster at the Family Kingdom Amusement Park in July 2021. The lawsuit alleges that the roller coaster ride was more dangerous than typical rides and was not examined correctly, creating unsafe and hazardous conditions.
Ride’s Safety measures in question
The suit reads, “Defendants knew or should have known that the roller coaster required extensive maintenance and refurbishment prior to use and encouraging persons to use the roller coaster when it was unreasonably dangerous and unsafe with a significant potential to cause serious injuries to its users.”
The woman is demanding actual and punitive damages from the defendants. Meanwhile, Family Kingdom, through their attorney, has shown disappointment regarding the lawsuit, divulging that the incident in question allegedly occurred 20 months before they owned the park. Further comment on the matter is withheld considering pending litigation.
Previous Lawsuits linked to the coaster
This is not the first lawsuit linked to the Swamp Fox. Public records suggest that a separate lawsuit was filed against the coaster ride in 2019, alleging that the ride exacerbated the plaintiff’s prior back injuries, claiming the ride was much rougher than normal roller coasters. Nevertheless, the case was dismissed in 2020, with the judge ruling that the plaintiff couldn’t provide concrete proof against Family Kingdom causing her injuries.
